Restrictions on prescribing, administering or supplying drugs

Section 57 of the Controlled Substances Act 1984 empowers the Minister responsible for The Act to issue and serve an Order on a person if they have:

  • been convicted of an offence against The Act or
  • in the Minister’s opinion, breached or failed to comply with a condition of a licence, authority or permit granted under The Act or
  • in the Minister’s opinion, prescribed, supplied or administered a prescription drug in an irresponsible manner.

The Order prohibits the person from manufacturing, producing, packaging, selling, supplying, prescribing, administering, using or having possession of any substance or device specified in the Order. The Order does not apply to medications lawfully prescribed to that person or to an animal under the person’s care.

Current orders

Current Section 57 Orders (PDF 185KB) lists the persons who are currently subject to a Section 57 Order. This also includes persons who have similar action imposed under the former Narcotics and Psychotropic Drugs Act.

Unless otherwise indicated, the Order covers the prohibition on the possession, prescribing and administration for schedule 8 drugs (drugs of dependence).
