Consultation on the Draft Model of Care for Youth Treatment Orders

Drug dependence can have a devastating impact on young people and their families. At the 2018 election the State Government committed to establishing a program to enable the Youth Court to require mandatory drug treatment for a young person dependent on a controlled drug. The Government passed the Controlled Substances (Youth Treatment Orders) Amendment Act 2019 (the Act) in November 2019. The Act establishes mandatory treatment for young people under 18 who are experiencing drug dependency, as a last resort and where all other appropriate and less restrictive means have been exhausted.

Phase 1

The Draft Model of Care for Phase 1 of Youth Treatment Orders (PDF 368KB) will only apply to young people in the Kurlana Tapa Youth Justice Centre who receive an Assessment or Treatment Order through the Youth Court. Commencement of Phase 2 is contingent on the review of the Youth Treatment Orders program, as required by the Act, and a further decision by the Government.

The Model of Care has been informed by the best available evidence for the treatment of young people. Special consideration has been given to the provision of trauma informed care and the specific and complex needs of at risk groups of young people. The safety, privacy and rights of young people are embedded throughout the Model of Care through both court and health processes.

Consultation

The State Government wants to hear the views of a wide variety of stakeholders, including people who will be directly impacted by the Model of Care for Youth Treatment Orders, particularly young people and their families, including Aboriginal people. The views of key stakeholders and the community play an important part in ensuring that the final Model of Care is the most robust, evidence informed, and effective document to achieve the outcomes of the Government’s election commitment.

The consultation will be open until 5.00 pm on 31 January 2021.
